Deposit. The deposit listed above is due at the time of signing and is non-refundable under all circumstances. The event date is not reserved until the deposit is received and this agreement is signed by both parties.

Cancellation by client.

• 30 or more days before the event: deposit is forfeited; no balance is due.
• 15–29 days before the event: deposit is forfeited; of the remaining balance is due.
• Within 14 days of the event: deposit is forfeited; 100% of the remaining balance is due. At this stage, ingredients may have been purchased and other orders turned away.

Cancellation by baker. If the baker must cancel due to circumstances beyond their control (see §8, Force Majeure), a full refund of all payments received will be issued within business days.

Design change requests must be submitted in writing (email or text) no later than days before the event date. Changes requested after that date may be declined at the baker's discretion. Approved changes that increase material or labor costs will be billed at the baker's standard rate and must be paid before delivery.

The baker reserves the right to make minor design substitutions (e.g., specific fresh flower variety, ribbon color) if a listed material becomes unavailable, while maintaining the overall aesthetic agreed upon. The baker will notify the client of any such substitution.

Neither party is liable for failure to perform their obligations if such failure results from events beyond their reasonable control, including but not limited to: natural disaster, acts of god, power outage, fire, pandemic, government order, or other unforeseeable circumstances. In such cases, both parties agree to negotiate in good faith toward an alternative date or a fair resolution.

The baker will make reasonable efforts to accommodate dietary restrictions and allergies communicated in writing before the design cutoff date. However, the baker's kitchen handles common allergens including but not limited to: . The baker cannot guarantee a fully allergen-free product. The client assumes responsibility for informing guests of ingredients and potential allergen exposure. The baker is not liable for allergic reactions.

The baker's total liability for any claim arising from this agreement shall not exceed the total amount paid by the client. The baker is not responsible for damage to the cake occurring after it has been delivered and accepted by the client or venue. The client is responsible for providing an appropriate environment for the cake (temperature-controlled, level surface) at the venue.

This agreement is governed by the laws of the state of . Any dispute not resolved between the parties will be settled by binding arbitration or small claims court in .

This document constitutes the entire agreement between the baker and the client and supersedes all prior verbal or written discussions. Any modifications must be agreed to in writing by both parties.
